[Populace] Shire Meeting on November 17 2006

Greetings unto the Populace of the Shire,

I have managed to get brief online access in order to address a concern
which arose late last Wednesday night.  Due to Internet access time
contraints my response will be brief and to the point.

The concern over the Shire's compliance/non-compliance with the Amercian
with Disabilities Act and the Shire's perceived treatment of its disabled
members was referred to Sir Edward, the East Kingdom Seneschal and Baron
Duncan, the Southern Region Seneschal for opinion and copied to the
Accessibility Porter for the East Kingdom as well.  The following was copied
and paste from Baron Duncan's response as well as the one from Sir Edward.
The concern and the responses as noted below have also been forwarded by
Baron Duncan and Sir Edward to the Society Seneschal.  My thanks and
gratitude to Sir Edward and Baron Duncan for their immediate attention to
this concern.

In accordance with the statements below, the Shire meeting will be held as
originally planned at the home of Lady Marietta.  Proxy ballots continue to
be an available option to those unable to attend.

I will not have Internet Access again until some point on Tuesday.  Emergent
issues may be addressed to me via cell phone 302-540-5887.

Subject to appropriate legal opinion, I would hold that the cited "places
of public accommodation" subject to the provision quoted below,

(a) When a place of public accommodation is located in a private residence,
the portion of the residence used exclusively as a residence is not covered
by this part, but that portion used exclusively in the operation of the
place of public accommodation or that portion used both for the place of
public accommodation and for residential purposes is covered by this part.

refer to such things as doctor's offices or legal offices, which often are
located within or as part of the practictioner's private residence.



My initial assessment is the same as Duncan's
